Notice & Takedown Policy
Effective Date: March 5, 2026
1. Overview
MapleMarket respects the intellectual property rights of others and expects its users to do the same. This Notice and Takedown Policy explains how rights holders, affected parties, and members of the public can request the removal of content from the Platform that infringes their rights or violates applicable Canadian law.
We are committed to responding promptly and fairly to valid takedown requests. This policy covers copyright infringement, trademark infringement, stolen property listings, fraudulent listings, privacy violations, and other illegal or rights-infringing content.
2. Copyright Infringement Notices
If you believe that content on the Platform infringes your copyright, you may submit a written takedown notice to our designated agent. Your notice must include the following information:
- Identification of the copyrighted work: A description of the copyrighted work you believe has been infringed. If multiple works are involved, provide a representative list
- Identification of the infringing content: The specific URL(s) or a detailed description of where the allegedly infringing content is located on the Platform, with sufficient detail for us to identify and locate the material
- Your contact information: Your full legal name, mailing address, telephone number, and email address
- Statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- Statement of accuracy: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
- Signature: Your physical or electronic signature
3. Trademark Infringement Notices
If you believe that a listing on the Platform infringes your registered trademark, you may submit a takedown notice. Your notice must include:
- Identification of the trademark, including the registration number and jurisdiction of registration
- The specific URL(s) of the listings you believe infringe your trademark
- An explanation of how the listing infringes your trademark rights (for example, sale of counterfeit goods bearing your mark)
- Your contact information (full legal name, mailing address, telephone number, and email address)
- A statement of good faith belief that the use of the trademark is not authorized
- Your physical or electronic signature
4. Stolen Property Reports
If you believe that a listing on the Platform offers property that has been stolen from you, you may request its removal by providing:
- A description of the stolen property, including any identifying features, serial numbers, or distinguishing characteristics
- The specific URL(s) of the listing(s) you believe offer the stolen property
- A copy of the police report filed for the stolen property, including the report number and the police service that received the report
- Your contact information (full legal name, mailing address, telephone number, and email address)
- A statement confirming that you are the lawful owner of the property or are authorized to act on behalf of the owner
We strongly recommend that you also contact your local police service and provide them with the listing information. We will cooperate with law enforcement investigations related to stolen property.
5. Fraudulent Listing Reports
If you believe that a listing is fraudulent — for example, it misrepresents the item, uses stolen photographs, offers an item that does not exist, or is designed to defraud buyers — you may report it for removal by providing:
- The specific URL(s) of the listing(s) you believe are fraudulent
- A detailed explanation of why you believe the listing is fraudulent, including any evidence you have (screenshots, communications, etc.)
- Your contact information so we can follow up if needed
You may also use the "Report this listing" button on the listing page for a quicker submission.
6. Privacy Violation Reports
If a listing or user content contains your personal information without your consent — such as your name, address, phone number, email, photograph, or government identification — you may request its removal by contacting us with:
- The specific URL(s) of the content containing your personal information
- Identification of the specific personal information you want removed
- A statement that you did not consent to the publication of this information
- Your contact information for verification purposes
7. Other Illegal Content
If you believe that a listing or content on the Platform violates Canadian law in a way not covered by the categories above — for example, content that promotes hatred, threatens violence, or involves exploitation — you may submit a report by contacting us with the listing URL and a description of the legal concern.
For content involving immediate threats to safety or criminal activity in progress, please contact your local police service or call 911 before reporting to us.
8. How to Submit a Notice
All takedown notices and content removal requests should be sent to:

Please include "Takedown Request" in the subject line of your email, along with the type of request (copyright, trademark, stolen property, fraud, privacy, or other).
9. Our Response Procedures
Upon receiving a valid takedown notice, we will follow these procedures:
Acknowledgment
We will acknowledge receipt of your notice within two (2) business days. If additional information is needed to process your request, we will contact you promptly.
Review
Our team will review the notice and the identified content. We will evaluate the notice against our policies, the Platform's Terms of Service, and applicable Canadian law. In cases involving clear violations or urgent safety concerns, we may take immediate action before completing a full review.
Action
If we determine that the content violates our policies or applicable law, we will take one or more of the following actions:
- Remove the identified content from the Platform
- Disable access to the identified content
- Issue a warning to the user who posted the content
- Suspend or terminate the user's account
- Preserve evidence and refer the matter to law enforcement where appropriate
Notification to the Affected User
When we remove content based on a takedown notice, we will make reasonable efforts to notify the user who posted the content, unless doing so would compromise a law enforcement investigation, endanger any person, or otherwise be inappropriate under the circumstances. The notification will include the reason for removal and information about the counter-notice process (where applicable).
Timeline
We aim to process takedown requests according to the following timelines:
- Urgent matters (safety threats, exploitation of minors, active criminal activity): Within 24 hours
- Copyright and trademark notices: Within five (5) business days
- Stolen property reports: Within three (3) business days
- Fraudulent listings: Within three (3) business days
- Privacy violations: Within three (3) business days
- Other content: Within seven (7) business days
These timelines are targets and not guarantees. Complex cases may require additional time for investigation.
10. Counter-Notices (Copyright)
If your content was removed based on a copyright infringement notice and you believe the removal was in error or that you have the legal right to use the material, you may submit a counter-notice. Your counter-notice must include:
- Identification of the content that was removed and the URL where it previously appeared
- A statement under penalty of perjury that you have a good faith belief that the content was removed by mistake or misidentification
- Your full legal name, mailing address, telephone number, and email address
- A statement that you consent to the jurisdiction of the courts in the Province of Ontario, Canada
- Your physical or electronic signature
Upon receiving a valid counter-notice, we will forward it to the original complainant. If the original complainant does not notify us within ten (10) business days that they have filed a legal action seeking a court order, we may restore the content at our discretion.
11. Repeat Infringers
MapleMarket maintains a policy of terminating the accounts of users who are repeat infringers. A user is considered a repeat infringer if they have received two or more valid takedown notices, or if their account has been associated with repeated violations of intellectual property rights or other rights of third parties. We reserve the right to terminate a user's account after a single violation in cases involving egregious or willful infringement.
12. Good Faith and Misuse
All takedown notices must be submitted in good faith. Submitting false, misleading, or fraudulent takedown notices is a serious matter that may result in legal liability. Under Canadian law, making materially false statements in a takedown notice may expose the submitter to claims for damages.
We reserve the right to disregard notices that appear to be submitted in bad faith, for competitive purposes, or as a tool of harassment. We also reserve the right to take action against users who repeatedly submit false reports.
13. Preservation of Evidence
When we remove content in response to a takedown notice, we may retain copies of the removed content for a reasonable period for the following purposes:
- To comply with legal obligations or respond to legal process
- To cooperate with law enforcement investigations
- To resolve disputes between users
- To enforce our Terms of Service and other policies
Retained content will be handled in accordance with our Privacy Policy and applicable Canadian privacy laws.
